CA Public Resources Code 42972 (c)(3)(B) states: Each retailer and wholesaler shall add the assessment to the purchase price of all carpet sold in the state. The assessment shall be clearly visible on invoices or functionally equivalent billing documents as a separate line item and shall be accompanied by a brief description of the assessment or a label approved by the department – Department of Resources Recycling and Recovery (CalRecycle).
All carpet sold in and/or shipped to California must include the correct assessment fee. This includes internet based (on-line only) sellers. Some California carpet retailers may not be operating in compliance with current assessment fee requirements. See the Differential Assessment webpage for assessment and compliance details.
If you are aware of a retailer that is not in compliance, please let CARE know by completing the form below. If you would like to report non-compliance directly to a member of CalRecycle’s EPR Enforcement Team, please visit their website at CalRecycle.ca.gov/EPR/Enforcement/.
